An intermediate appellate court in Waco has dismissed the NCAA’s attempt to overturn a decision that cleared Texas A&M guard Rashaun Agee to compete this past season, allowing the player to finish the campaign and help the Aggies secure a spot in the NCAA tournament.

Agee, a Chicago native who previously played at New Mexico State, Casper College, Bowling Green and the University of Southern California, sued the NCAA after it denied him a waiver for an additional year of eligibility. The lawsuit resulted in a temporary restraining order issued by state District Judge G. Jerell Wise, a ruling the NCAA subsequently appealed.

The appeals court concluded that Agee’s decision to drop his lawsuit rendered the NCAA’s appeal moot, effectively ending the organization’s challenge to the injunction that had blocked its eligibility ruling.

During the 2025‑2026 season Agee appeared in all 34 games, starting 33 of them, and posted averages of 14.6 points, 8.7 rebounds and 27 blocks. His performance earned him a place on the All‑SEC third team and has sparked broader discussion about the future of eligibility waivers in college athletics.
